Jacobs won't accept my offer plus vulnerable

Post by rriley1991 »

They are currently intimidating me with a council tax debt I've broke the agreement twice once I didn't have the money the second time my bank card was froze they also had a problem with their recurring card payment system 1 month and tried to send the bailiffs out I am a vulnerable single father I suffer with depression and anxiety they won't accept my agreement of £20 a month and want £210 in full in 6 days or they are sending bailiffs out I live alone with my 4 year old son I don't want them showing up but there's nothing I can do about it I spoke to the national debt advice and they told me to not let them in they can't force entry if they haven't been in your property before and just keep offering the £20 a month the debt help guy told me if I haven't got the money they can't get blood out of a stone but what happens if they arrive when I'm ready to take my son to school I'm going to have to open the door then they can get there foot in the door I'm snookered really

It looks like you are a vulnerable person which means the bailiff may not take control of goods until you have been given an adequate opportunity to get advice in relation to the enforcement power.

If the bailiff does not follow this, then he cannot recover any enforcement stage fees and charges.

Earlier this year, a client of mine brought a case in the High Court which came out in his favour. The client was vulnerable and the court disallowed all the bailiff's enforcement fees and charges.

The case is Progressive Property Ventures LLP v Mrozinski [2022] EWHC 1256 (QB) (24 May 2022)

The bailiff is collecting a council tax debt.

You need to make a formal complaint stage 1 telling the council you are a vulnerable person and ask them to withdraw enforcement.

You then have a list of options open to you.

Thank you for the reply I will speak to the council and make a complaint

I recieved this off them today after offering them £20 per month numerous time you just can't seem to reason with them at all

Hello,

Unfortunately, as advised, the lowest balance is required to be cleared first in order to set another arrangement due to the number of defaults.

If you are unable to adhere to this, then we are required to continue with enforcement.

Simon Jacobs is messing you about.

There is no power to enter private homes by force, so I would leave it there until such time the council is ready to receive payment.

This article shows you how to protect yourself from bailiffs
