Hello,

Can someone please help me?

I got two PCNs for using the Dartford Tunnel last year. My dad was dying and I wasn't paying full attention when driving as I was very upset, and went through it, when I was meant to get off at the junction before. So I immediately came back, and they issued me two tickets. You can see from the timestamps of the two tickets that they differ by just a few minutes, so that is proof that this was a genuine mistake, and I am sure they would take the mitigating circumstances into consideration and waive the fine. The problem was I was devastated at my dad having died, and did not appeal in time, and Marston then contacted me in October, stating

Unfortunately, I forgot to do this. Just to clarify, my mental health has been really bad for the past few years, I have been unemployed since 2014, my career is in tatters, and doing the simplest of things can be very difficult, and I genuinely did forget to do this.

I heard absolutely nothing from Marston since. Then today, as I was leaving home after noon, I saw a letter titled "Notice after entry or taking control of goods on a highway", and it stated that my car has been clamped and I have to pay 425 pounds to release it. This was a bombshell, I need my car to visit my mum who lives 70 miles away, I take her to her hospital appointments, in January her doctor asked me to take her to A&E because the doctor was worried about her, I always need my car in case there is an emergency, so I called Citizens Advice Bureau, because I thought surely they cannot just come and clamp your car without a warning? I mean, surely there must be a process, Marston's email mentioned nothing about taking control of goods, I have heard nothing from them since, surely this cannot be correct, my degree is in Computer Science, I know nothing about the Law but I know a lot about Logic, and logically, there has to be a process before they can just clamp your car, like some discussion, but CAB said I must pay the money, the woman said she will send me 150 pounds in food vouchers to help me, but the other money I had to pay from what my mum has lent me, I am already in so much debt, and now this just means more debt that I will have to pay back.

Just to clarify, I heard absolutely nothing from Marston since October, I even forgot about this charge, then today I had the notice, and on the notice the guy had written that I have to pay by 12.00 today or they might take my car, and when I phoned him, pleading with him to unclamp it, he said he won't until I pay him 425 pounds. Does the law allow this? Can they just clamp a car without even telling you they are about to clamp it?

Can I claarify a few things...

1) Did you make an OOT appeal via the appeal procedure and your appeal was not granted?
If you haven't appealed then I suggest you do one now, however do be prepared for the mitigating circumstance to be dismissed.

2) You mention Marstons got in touch, was this via a notice of enforcement? As it looks like their reply if to a letter you may have sent.

So far it looks like the have abided by the correct procedure unfortunately But there are some areas we need to explore.

Is your car on HP or lease etc? What is the value if not?

You mention you have been unemployed since 2014, if so what benefits do you receive?
I am surprised the CA gave you this advice as they are trained to deal with priority debts immediately, and bailiffs are classed as a priority debt. However, your answers to the above will give an indication as to what you actions you may be able to take.

Many thanks for your reply.

I bought my car in 2014, just a few months before I was made redundant. It was valued at 2000 pounds then, is less than 1000 pounds now.

Currently I am on Universal Credit. I also have a history of mental health problems (on and off), and am on medication for that.

As for whether I got a Notice of Enforcement, I don't know. All I got was that email I have provided - is that a Notice of Enforcement? To me this is all confusing ... the email states they "may" visit the premises, and my goods "may" be at risk. Surely if they want to take over my car, they should tell me officially this is about to happen? I just don't understand how they can send me an email in October telling me they may visit and my goods may be at risk, then I hear nothing for them for five months, and then suddely they have clamped my car.

When I go to the Dartford Charge website to enter the PCN

it cannot find it ... I don't know why this is. It is definitely the correct PCN and VRM. Could this mean that Highways England no longer own the debt and have sold it to Marston or something like that? Sorry, I have no idea what is going on.

Sorry, just to clarify, I must have got a letter from Marston saying they are looking for a payment, the standard debt collector letter, to which I replied explaining what happened, and to which they replied with the email above.

Now I am absolutely certain the original letter wasn't a Notice of Enforcement telling me they are about to take my goods, because if it was, I would have been very worried and would have moved my car onto the drive at the back of the house, but as I cannot even remember receiving the letter, it must have been a standard one to which I replied.

And after I replied, I got the email above. Surely this can't be a Notice of Enforcement, because I would have thought that a Notice of Enforcement would give you notice that enforcement is about to occur whereas the above email just talks about how they may visit and my goods may be at risk?

Clicking on what "This is what a Notice of Enforcement looks like", I definitely did not get one at all. I can 100% say I did not get it last year and that I got one of those normal debt collection letters instead, where they tell you they are now in charge of the debt and ask you to make a payment, to which I replied with email on October 2020 explaining that I accidentally went through the tunnel and immediately came back (hence the two PCNs differing by just a few minutes), and they replied with the email on October 2020 (that I quoted in the first post).

So does this mean they acted unlawfully? Or could they claim the email they sent me (which is quoted in my first post), is the Notice of Enforcement? I just think it is so immoral that someone can come and clamp your car out of the blue, it is so scary when you need your car to be able to see your mum at any time and you start worrying what if there is an emergency and you need to go and see her but cannot because you don't have your car, this kind of behaviour shouldn't be allowed.

If the address on the warrant is not your current address. Then make a late witness statement and attach evidence of your address.

That puts the enforcement to bed.
