Court enforcement letter

Post by PUDDLEDUCK22 »

  Morning everyone
Just need some help that I did think was sorted months ago however now it surfaced again
Debt to credit union (in adminstration)
Sent was 1680.15 on 25 May 18
Notice of enforcement via ELLIOTT AND DAVIS on 5.6.18 debt now 1797.90
Then notice of attendance 0n 20 6. 18 bill 2187.71
27.6.18 2187.71.
I took advise off here although (stay the writ) I rang the court etc because I didn't fill form in right got that sorted
Never had anything from court at all I couldn't pay the fee because of money situation I was on a low income coming forward few months I have new contract EITH more hours money going into one big black hole lol
Rent debt is now 1700
Attachment earning council tax last month they took 140
D.w.p attachment 40.00 month
Plus all the other stuff .
Then Friday had letter from court enforcement services saying they had instructed ELLIOT AND DAVIS to take control of goods (I don't lose them in Don't speak to them) the amount it states i owe is 2187.71 no fees have come off so not sure whats happened
I did offer 5.00 month the baliff said no we have to have it all and of course they have no chance of that (Because if I had money I wouldn't be having all this hassle)
Is there any way i can a up to 100 quid and get some one to do the paper work for me to stay the writ please
(I have no internet at home as changing provider won't be up and running till next week.
I could do without all this hassle and stress parking car 15mins away as don't finish work till 10pm
Just on a tecinal matter my is not correct on the letter

You cannot negotiate with the bailiff company, they will mess you about and in the case of High Court, they are only interested in screwing you out of as much fee money they think they can get away with.

You can apply to stay the writ of control, then set aside the judgment

If you don't have ground to stay the writ, then apply to vary the judgment. Either way, that stops the bailiffs and rids you of the fees.

A typo in your name does not impact the validity of the enforcement, its called the 'slip rule'. A wrong person named revokes everything.

Hi thanks for reply I'm on low income certainly couldn't afford to pay much will your suggestion of Staff the writ still apply as it's being going on a while now I know I spoke to the court they were 3 weeks behind with all case worth the court was Northampton business centre but I think the paper work the bailiff brought has Newport county court on it dated 25 . 5 .18 apart from the fact I can't pay the sum they refuse to speak to me I'm still not sure is Stay the writ still apply to me as I do owe the money
Your other link isn't working is there some were I can get help filling in paper work ?
As last time I had nothing back at all and as far as I knew I had stopped this happening
I could just about scrape the 50.00 fee if that helps getting it sorted my local c.a.b office very hard to see they tend to give you all paper work send you out the order
Thanks for advise

You can apply for fee remission. If you need help completing the forms and paperwork, then go to the High Court in London and visit the PSU (personal Support Unit) on the first floor in the east block and a volunteer can help you through the process and get your application before a high court master.
