Received Letter from Collect services for huge sum

Post by sekharsoftware »

Hi,

I have received a letter recently from collect services, Egham stating that i had committed an offence by being in the bus lane. The sum is £583.

This is the first time i have received letter from them to my new address. I have also a reply for my email saying that they have sent letters to my old address. This is because the Vehicle address is with old address (I made a mistake by not changing the Vehicle reg address but i have been paying all taxes on time).

Do i have any chance for appealing for this notice considering my current address is being updated and also considering this is the first time i received any notices from them. Will they consider any less amount?

Thanks,
Raj

If the bailiff has admitted sending documents about the fine to your old address, then its proper course of action is to tell the council who then must approach the Traffic Enforcement Centre and apply for a new warrant of control under CPR 75.

It shows the bailiff company is cheating by trying enforcement at your current address when it knows the warrant has your old address on it. It is acting in breach of provision 7.1 of Schedule 12 of the Tribunals Courts and Enforcement Act 2007.

You can stop the bailiffs by appealing the traffic contravention by downloading and completing forms PE3/PE2 and attach evidence of your current address. The TEC will revoke the warrant of control and roll back the fine to the original amount and it is up to the council to decide whether to pursue you for it.
