Executing a Claim

Post by Lincern »

Hello,

Kindly advise.

The County Courts have allowed me to make a Claim against a defendant.

Please let me know how long do I have, after the Claim has been issued, to instruct a Bailiff to issue a Warrant.

I have never done this before, so, please advise of the procedure.

Thanking you in advance. 8-)

If the value of the judgment is under £600, then its a county court bailiff. They are paid their fee regardless of success. Therefore they are not motivated to collect.

Otherwise apply for a charging order or a third party order. A high court writ is ineffective against a debtor that is not a company, or is a person with no reachable assets. High court bailiffs in this scenario can only use harsh language.
