wet warrant, liability or enforcement certificate

Post by livingman »

hi there im just trying to nail down what definitely is required when an enforcement officer arrives.
i used to believe by law a contract on paper needs to have a wet ink signature and under common law two signatures or autographs should I say as its an agreement/meeting of the minds.

however upon research it seems a digital warrant is sufficient as long as its a real one (all i know is it must have the coat of arms top left so appreciate any help with this)

I am also led to believe they must at least have a signed certificate from a judge? does that need to be wet ink?
does that need to be a named individual not the company?

appreciate any help I have searched for the answers but im still not clear  :(

An enforcement power does not need a 'wet-ink' signature. This article explains the law:

However, bailiffs must show on request evidence of his identity and the enforcement power. The law is Paragraph 26 of Schedule 12 of the Tribunals Courts and Enforcement Act 2007.

Bailiffs often show the enforcement power on a device, which makes it difficult to examine it closely and check the document with a third-party source.

The enforcement certificate does have a wet-ink signature of a judge.

Some bailiffs substitute their official court ID with fake ID, here's some examples:

It's always best to email the bailiff company for a copy of the bailiff's certificate and the enforcement power. Never telephone a bailiff company.

If the bailiff company refuses to produce or says its data protection act, then it opens several avenues of remedy for you to get the enforcement stopped.

thanks for getting back much appreciated. this may sound stupid but does the bailiffs cert area have to match the court issuing the warrant?
so if watford county court issued the warrant but his certificate was signed and said a different area would that matter?
the laminated card seems very easy to copy but i guess you can check an online register

The warrant and bailiff certificate don't need to be the same court.

Bailiffs don't need to make a fake certificate. They prefer to substitute them with police-like warrant cards.
