Civil Enforcement Limited Parking Charge

Hi There,Well there's first time for everything after driving for 56 years finally received a Parking Charge from these people after failing to pay at the Port of Wells Car park The Quay. Happened on the 10 April, didn't see the sign outside the carpark as it is low down and can be hidden by pedestrians. I went back to the vicinity today and took photos of the signage. The photo I have of the outside sign shows it partially obscured by persons standing in front. The next sign is inside the car park which can only be seen once you have committed to going into the car park, this can also be obscured by pedestrians. It was very busy when we arrived there and no spaces were available so we waited with the engine running for a space to become available. The vehicle I drive is a Discovery 3 and is quite large in addition I am a blue badge holder and need a parking space where I can open my door quite wide to get in and out. We noted there were no disabled bays and the normal bays were quite narrow so decided after about 10 minutes that this car park was not for us and tried to leave only to find the exit area was blocked so we were stuck (the entrance has a no exit sign). In all we were there for 24 minutes but never parked and never turned the engine off.The incident was on the 10 April and the Issue date was the 21st April. Is my reading of the Law correct that the Invoice from Civil Enforcement should have hit my post box on Friday 23rd April as they don't include Saturdays Sundays or Bank Holidays - that's 14 days after the day after the incident. I can prove that the letter didn't arrive on the Friday as I have CCTV cameras and can show exactly when the postman delivers the letter as you can see it in his hand (luckily it was the only letter that day)
Interesting when you search companies house on these guys that they are late submitting their accounts this year :shock: :oops:

If the signage is not visible from the driver sitting insude the car, then you can appeal the contravention.

Blue badge holder get certain rights on a highway, but might not apply on private land car parks.

That might mean you were not parked.

Parking a car could mean leaving a car in a place where a car cannot be left.

Another interpretation of parking I have seen, is stopping on a double yellow to chage a satnav because of a road closure.

This is a private parking ticket. Not a statutory traffic contravention debt.
