RPM Responsible Parking Management

Anyone had any dealings with these ?
I got a PCN for parking in the car park which I thought was council owned, one sign on entry which can easily be missed and just a blue sign saying pay and display which looks like the council's excact signage, due to covid and my knowledge that the council were allowing free parking I just presumed it was a council car park and nipped to the bank without display a ticket.

The vehicle I was using was on hire so obviously my details were provided by the hire company and the PCN landed £100 but reduced to £60.

On the letter it stated submitted with it was

Statement signed by the vehicle hire firm
Hire agreement
Statement of liability
Notice to keeper served

None of them were in the envelope

I don't want dcbl turning up or any ccja on my file . Do shall I just pay the charge??

Update.. I sent the temple off asking for various pieces of information . Received a letter back saying appeal not successful and no ticket was displayed, no information received what I asked for and now saying they having extended the date to pay the lower amount. Any ideas what to do now ?

They didn't give the information you asked for. Let them play the next move.

So I received another letter final demand . £125 then £160 in 7 days. Text says please as we may pass details to our solicitor who may seek to recover the charge. Solicitor may issue a letter before the claim . If remains unpaid after a letter it may proceed to the county court and further charges will be applied. If it remains unpaid or ignored the entire enforcement then we may obtain a ccj which may also result in bailiffs turning up...

They did not respond to the templet I used from here with information I asked and just wrote back saying extended the pay time.

Then this final demand landed.

I obviously do not want a ccj on file but what would be my next course of action.

If they ignored your letter of reply, then that could undermine the integrity of their claim.

If you kept a record of the date you sent the letter, and made file copies of their reply, then you can defend the claim.

They cannot recover solicitors costs in the small claims track for claims under £10,000.

I think their use of the word solicitor is to be intimidating. No solicitor in the real life would touch it.

Until they file the claim, there isn't much more you can do.

I would be surprised if they brought a claim knowing it will be a defended claim. It costs them too much money, so they rely on undefended claims to make money from private parking.

Hi update.

Just received a letter from Gladstone's solicitors asking for £160. States " at this time our client wishes to avoid costly court proceedings and would much prefer to style now "

If not made within 14 days no option but consider further action.

The ending " our team is ready to work with you to resolve this matter without need for court proceedings.

Responsible parking management never answered the template i sent from here in the beginning.

Do I make contact with the solicitor and explain that.

Just don't want a ccj as buying a new house soon.

If you don't want a CCJ then see if they file the claim, then offer to settle.

I sent the template to the parking company and they failed to answer any questions instead extended the period for payment. Do I now send the template to Gladstone's. ???

I also got a text from Gladstone's this morning asking for payment.

I gather than one can also inform them that under GDPR you no longer accept text messages or email as a valid means of service or communication. Give them an alternative address (not yours) or use an email with a holiday reply on it saying the email address is not monitored regularly (you can still use the account to forward emails to yourself).

Change your number and move the sim to a PAYG service, then leave it out of a phone or in an old phone you only turn on to check messages etc.

I would also be putting their ignoring of your assertions in your template in any reply you make to them so that in the event it does go to Court you will submit these letters saying that you informed them of their error numerous times but they ignored it. A one off letter is fine but a chain of evidence really shows them up for wasting the Court's time.

There is no need to engage with the bailiff company about nuisance text messages.

Set your phone to block unknown callers, the nuisance messages will stop.

If your phone is an Android phone, the callers credentials are also blocked by other users, which renders the bailiff company’s app or software they use for sending unsolicited messages, useless, because nobody will be getting their messages.

The great thing about it, the bailiff company is blissfully unaware their text messaging app or service has been blocked.

Update..

Received letter from Gladstone's .
Basically letter states they act on behalf of the client and debt remains unpaid and or valid reason for non payment has not been provided.

Highlights the amount outstanding and states

We refer you to the pre action protocol for debt claims paragraph 7 and the practice direction for pre action conduct paragraph 13-16 contained in the civil procedure rules.

You should do one of the following in the next 30 days

Pay
Or
Dispute the debt via the online form

Then states

Warning regarding the issue of court proceedings

Our client is satisfied it has sufficient evidence to support any court proceedings

Should I fail to pay a ccj may be entered against you.

Summary

Our team is ready to try and work with you to resolve this matter without the need for court proceedings....

I used the template on here a few months ago and rpm failed to one send me reply to my email but did send via post and failed to answer the template points and just stated payment required..


Do I now send it Gladstone's or wait for the next move.
