Bailiff industry is shut down

For the first time in history, bailiff enforcement action has been suspended.

The source is from within the enforcement industry about 45 minutes ago.

One company has told its bailiffs to release clamped vehicles and TFL has ordered one of its enforcement contractors to return outstanding warrants.

Enforcement of high court writs have not been stayed but court service is not processing N293 transfer applications until further notice.

Vehicles held in compounds will remain there unless a court orders its return. Injunction application can still be filed but court service is staying them pending staff availability.

I'll bring more news as I receive it.

TFL suspended it's no emission zone cameras earlier today.

There have been various 'rumours' posted on the net claiming that bailiffs have been instructed by councils not to enforce debts at this present time given the 'virus' outbreak. This is clearly NOT the case. This position will no doubt change over the coming days.

During this time, the level of statutory debts such as council tax will continue to accrue as people's income fall, but new court fines and traffic debt cases will decrease during the lockdown.

We will not see an avalanche of enforcement when the lockdown is released.

People are still getting demands for private parking tickets, but the enforcement is put on ice.

There has been a sharp increase in people in the UK making wills and registering a Lasting Power of Attorney. But there is a drop in the number of people creating will trusts. They are short term simple wills. As home-visit will writers can't make home visits, they are turning to take instructions online and creating the documents digitally for clients to print and sign. Something never seen before in will writing.

When we emerge from post-coronavirus, there will be a new round of austerity on a level never seen before.

The lockdown still in force, private parking companies have re-opened and re-started giving out private parking tickets on private land from today.

The private parking companies are back with a vengeance handing out parking charge notices and defending them, is well underway.

Bailiffs due to be back on the Streets on 23 June, might come sooner because councils are running out of money from the fall in the number of traffic offences due to COVID lockdown.

County Courts are processing claims at fractional speed, but High Court applications for stays, set-asides and variations are back to normal.

The Traffic Enforcement Centre has staff working from home taking calls for the Northampton call centre.

Notices of Enforcement before the lockdown may expire, but bailiffs may gamble their chances and start clamping cars after their expiry.

It's not understood what contactless enforcement means because paragraph 24(2) of Schedule 12 of the TCEA made all enforcement contactless since 2014, repealing CIVEA's former self, lobbying to give bailiffs immunity from liability for using violence against debtors in section 27 of the Domestic Violence Crime and Victims Act 2004.

Helplines are ringing again, suggesting some bailiffs are unofficially back on the streets. Its mostly High Court and drive-by clamping matters.

COVID-19: Bailiffs are back on the streets on 24 August 2020

Social distancing rules still apply, but it's unknown how that will work in the confrontational nature of civil enforcement.
