Can anyone Help ASAP! Phoenix collections

Post by LittleElf »

Hi all

I've received this through my front door today.

I've telephoned the bailiff and he stated that I owe the amount shown £393.00 for an unpaid parking fine from the council for an old vehicle I had back in May of this year. I cannot remember this and there is no breakdown on the letter

He stated the company have sent two letters which I have requested copies of. He said he has a warrant for my address to enter the property.

I have told him I'm a vulnerable adult with a young child as I suffer with a mental health condition of PTSD and am under the mental health team and he stated from what he could gather on the phone I have full capacity to deal with this as I have recently just gone back to work.

I have just recently gone back to work due to having months off due to my PTSD condition.

He said I need to ring around family and friends and find the funds and he's ringing me back tomorrow!

What do I do?

It's a bailiff's phishing letter.

Designed to see if an occupant contacts the bailiff, admits their identity and living at the address the document was given.

The law says the bailiff must give a statutory Notice of Enforcement.

This is what it should look like.

If you have changed address, then make an "out of time" witness statement or statutory declaration, depending on whether it’s a moving traffic offence.

Here is the procedure.

It is possible to appeal a PCN after receiving bailiffs.

If you are a vulnerable person, the law states the bailiff must give vulnerable debtors time to seek advice in relation to the enforcement power.

This article explains more:

And here is a free template to suspend the enforcement.

Don't answer your phone.

Don't open the door - ever to a bailiff.

Keep that door locked shut. Even if the police and the bomb-squad are outside threatening to blow the house away,

Speak through a window, hand him the vulnerable people letter and ask him to leave quietly.

See if you have grounds to stop the enforcement. Here is a list of options.

Okay thank you I wont do.

I have sent the email to the council and to the company regarding the enforcement fee as I am a vulnerable person.

I cannot find the text message to send to the bailiff regarding the the same though.

If you created a letter then send it by text to the bailiffs mobile and take a screenshot of the sent text message showing the time it was sent.

Thanks for all your help.

I sent the letter via email and post and they responded straight away, the bailiff has backed off and I don’t have to pay the enforcement fee and I am dealing directly with the council and the bailiff is to have no contact.
