HCEO visit with no NOE

Hi,

New here and looking for some advice/help/ideas asap. Briefly got a ccj, claimant choose to enforce it, suddenly HCEOs turn up - and no NOE had been sent - although apparently 'everyone says that'.

Some money was raised (which has caused significant other damage)to remove them but not enough to clear the debt, especially with their charges that they carefully and gleefully added! Now claiming that an unsigned instalment plan is legally binding and threatening again. Meanwhile my situation has changed and now have no income which can prove, which doesn't seem to actually matter to these guys, and there are no savings or other assets.

I am bemused that although they acted illegally I am now expected to act as they say and I am almost being treated as a criminal - which surely cant be right. I want to stop everything especially their activities immediately, so there is time to deal with this properly as the way this has been handled can not be correct or just in any sense of the word, and then deal with them properly.

If the bailiff company is DCBL then you did not get a NOE.

They don't give one, and when a court is asked to make a finding whether they gave a NOE, the finding is they did not.

No payment arrangement is ligallaly binding unless its a signed controlled goods agreement. But those are rarely used.

The fee regulations discourage bailiffs using them.

Thank you Zeke fast work - you obviously know your stuff, is no NOE from them a fact?

Its been found on several occasions.

DCBL dont give a NOE because they know the court will believe they did.

Ah - going down the ‘better to ask for forgiveness rather than ask for permission’ route!

Let me have a read and I will come back with more questions - how come they haven’t had their license removed?
