Marstons removal notice

Post by chiefydudds »

Came home from work yesterday to find marstons had been and left a removal notice with the threat of coming back.

It was for a parking ticket but the bill is now £420

Read elsewhere I only need to pay the original fine not any fees, is this true?

Problem is the letter only shows the final total so far

What do I do

Yes, but it doesn't get you off the hook with the fees.

Paying the council only ends the enforcement power. The fees are still owed, but the bailiff cannot take control of goods in respect of them.

The bailiff cannot sue you for the fees because the claim will be dismissed on the grounds of locus standi, meaning the bailiff does not have a right to bring the claim because the fees are owed, not to him personally, but to the bailiff company he is working for.

To identify the amount on the warrant of control is to contact the council, or phone the Traffic Enforcement Centre on 0300 123 1059 and give the PCN number.
