Hello!
In May I went away with a friend for her birthday for a couple days and invoked a DART charge, though I had no idea it was a paid for road and missed the signage on the way there.
I only learned about it because of a letter I received from JBW saying I owe £425.50 for an unpaid charge!
The car was a rental, and they had an old address on file that I had forgotten to update when I moved, so I imagine between May and now the collection agency has been trying to recover money from my old address.
The letter says that a warrant of control has been issued to allow people to take goods out my home to the value of the charge?
Please help - what the F is going on?!
Thank you very much
Please help with a £425 DART charge
Re: Please help with a £425 DART charge
You need to gather and submit evidence of your current address and complete forms TE7 and TE9.
Here is the procedure. https://www.nationalbailiffadvice.uk/Ap ... liffs.html
JBW became disingenuous and traced you, then tried to start enforcement at your current address without telling the creditor.
CPR 75.7(7) requires the creditor to re-issue the warrant with the respondents current address.
Enforcement fails. JBW cannot claim any fees.

Thank you!!
Am in danger of JBW taking anything from me or making me liable for anything while I'm sorting out the T7 or T9 forms?

When you email the completed forms and the attached evidence of your current address, the enforcement power is suspended.
