Bailiff tried to seize vehicle in Bournemouth.

Visiting Bournemouth a bailiff tried to clamp the vehicle with me in it. I got away not knowing why he was trying to seize vehicle. Give me advice. He did not identify himself but said he was fetching the police. Give me advice.

What do I do???

You need to report the incident to the police as an attempted car-jacking.

Bailiffs cannot take control of cars that are being used. Regulation 10(2) of the Taking Control of Goods Regulations 2013.

He did not show paperwork but just had a clamp in his hand. HE said "I am seizing this vehicle " for which I knew he had used APNR to track me. I said he was not. I started the engine and he says he will call Police. I spend away. How do I find out that there is a PCN out for seizing my vehicle?

My problem is if I go to any of these cities with APNR vehicles patrolling I do not know if my car will be seized.

Do I wait for paperwork, and how likely are they to attend my home in the next few days???

If you know the council that issued the PCN then ask them for the PCN number, then call the Traffic Enforcement Centre 0300 123 1059, (press 4 to skip robot) and give the PCN number.

They will ask for a security check by asking you to say your postcode. Always say the postcode the car is registered to. Then ask for three things:

• 1. The warrant issue date
  2. The warrant address
  3. Warrant amount

If the address is different then make a late witness statement or statutory declaration enclosing evidence of your current address and state that you were not given the Notice to Owner (NTO). Here is the procedure. https://www.nationalbailiffadvice.uk/Ap ... liffs.html

A warrant only has a service life of 12 months from the date of issue. CPR 75.7(5) or if a Notice of Enforcement was given to your current then the bailiff may only take control of goods within 12 months from the date of issue, regulation 9(1) of the Taking Control of Goods Regulations 2013. If a notice of enforcement has a different address, the bailiff may not take control of goods.

I know nothing as I had not been given paperwork and I did not give him time to get the clamp on. I was in the car at the time. How can you find out the warrants are out?

I would just report it to the police as an atempoted car-jacking and if the police say the crime is a civil matter then ask on what authority the car jacking event took place.
