Jacobs have visited today regarding bus lane fine.
Story:
Jacobs clamped previous car in December, filled out OOT forms on grounds that I contested it but did not recieve it (on ground there was not enough adeqoute signage on where the bus lane was). It was rejected a month later, but when i tried to pay it to the council then it wasn't possible.
Now I have had another visit from them, since that time, I got rid of that car (it was on finance so was handed back) and have purchased a new car. Also I have changed my name so send paperwork off to DVLA yesterday to get my driving liscence name changed as well, (surname is the same, first name is changeD).
Jacobs have visited today, and said they need full payment for the fine or will remove goods tomorrow at 6 am (the usual). They will call back later today to see if I have the money (i answered the door to her).
Also to note, I have new car but that is under my new name, same surname, different first name. Do I just wait until the fine goes back to the council and then pay them? or is there any other avenue that I can pursue? Should I also park the car at my parents driveway (few streets away from my house)/
Bit of advice please, (sorry for long post)
Bus Lane Penalty Charge
Re: Bus Lane Penalty Charge
If you have changed your name, it doesn't change the ownership of your goods. The bailiff can still take control of it.
Clamping a finance car was a big risk on the part of the bailiff. You could have got an injunction to release the car and the bailiff company flushes over £8,000 down the toilet every time. That is why Newlyn plc, another bailiff company who was big on targeting finance goods, stopped clamping finance cars.
You new car is in peril, unless that is also on finance, or you park it in full view on a neighbors driveway, so your parents driveway is perfect. Bailiffs can only take control of goods on the debtors property or on a highway.
Provided you do not open the door to the bailiff, you should be fine. If a bailiff causes a disturbance or is confrontational, then call police on 999 and remember to keep the door shut until the bailiff is safely away from the property. The council will eventually move on if the bailiff cannot recover the ticket.
