Dart charge Help Needed

Post by Dewalex »

I am new to this forum and I would need advice on the above issue please .
I have an account with dart charge for the family which is register on my wife's name , on the day of the contravention I thought I had enough money on my dart charge account, but I realised after about 2 days after the crossing.
I phone up dart charge customer service and explained to the person I spoke to , she then advice that I should go and pay the £2.50 which I paid and that they will let go the offence since it was my first offence.

I later got a charge certificate and due to out of site and for the fact that the letter was address to my wife , When I noticed the Charge Certificate it I phone dart charge again and explain the person I spoke with said I would have to pay the fine. I then appeal the charge certificate and it was refused simple because the time frame has lapsed . Order for recovery of unpaid penalty charge was sent again which is now £115.50 due to carelessness again the time allow for form TE9 has lapsed again. what are my option please? thanks all for taken your time to read my long explanation.

If you appeal after paying the fine, the appeal with be dismissed "the authority reports the charge has been paid". Dart Charge has deliberately given you wrong advice.

Appeal the charge on the grounds (write on the form) :

"On DATE the authority agreed to revoke the charge on payment of the initial charge but changed its mind without telling me. On DATE I received a charge certificate and the authority told me to pay the charge again and appeal it retrospectively knowing I cannot appeal a charge after the penalty has been paid"

Give TPT a call and see what they say.: https://www.trafficpenaltytribunal.gov. ... to-appeal/

If the ticket has reached bailiffs stage, then see this checklist: https://www.nationalbailiffadvice.uk/Ba ... Sheet.html

Where did you send it?

You should send the forms by email rather than recorded delivery. Here is how to appeal a PCN. A TE7 by itself is only a late witness statement, you need to do a TE9 (dart charge) as well.

I have looked at form TE9 non of the condition is applicable to my situation as the time to complete the witness statement has passed.

You can appeal out of time if you give a reason.

Call 0300 123 1059 (press 4 top skip the robot) and when you speal to a human, ask the progress of your TE9/TE7.

There is a propensity for the TEC not to tell you the outcome of an appeal if it is unsuccessful and the first you learn is bailiffs springing a surprise ambush.

You can take it to tribunal. Expensive. Or pay the council.

The probable reason for dismissal is the PCN was already paid.

It was a DART charge and it has not been paid yet I was given an option on non appearance hearing costing £100 or over £255 if I wanted to appear in the hearing .Its with bailiffs at the moment standing over £375

If it is unpaid and you want the case returned to TFL then you need to protect your home and car from bailiffs.
