Warrant of control!
Warrant of control!
Hi all, i have an outstanding debt with a company called Swift which has come from magistrates court. it was a littering fine last year. Long story short i owe £687 and as i broke my first installment plan with them they now want it in full. I am currently living with my parents... Paying it is out the question i just dont have it. I am aware they COULD force entry if granted permission. My parents do not have purchase receipts for their cars, or pretty much anything they own in the house... could someone please advise us what we can do in regards to them controlling goods? Someone told me we could get a statutory declaration from a solicitor which proves they own all goods is this correct? and will prevent them from taking anything?
Any advice will be much appreciated. I am really worried about this debt and paying it is not applicable right now as im in server financially difficulty.
Thanks
Chris

Re: Warrant of control!
If you don't have the money to pay the fine in full then you can do a change of circumstances and that takes the bailiff out of the loop. Here is how it's done.

If this does not apply to you, here are some other steps you can take to stop the bailiffs: https://www.nationalbailiffadvice.uk/St ... liffs.html

Re: Warrant of control!
Thanks for that, but I cant really work out what all that means after reading it, excuse my lack of knowledge What sort of changes would be applicable to stop the bailiffs as you say?Schedule 12 wrote: ↑13 Aug 2018 15:25 If you don't have the money to pay the fine in full then you can do a change of circumstances and that takes the bailiff out of the loop. See if any of these remedies are open to you: https://www.nationalbailiffadvice.uk/St ... liffs.html
If no joy, then run this checklist: https://www.nationalbailiffadvice.uk/Ba ... Sheet.html
If that still doesn't work, then batten down the hatches: https://www.nationalbailiffadvice.uk/Pr ... Goods.html

Re: Warrant of control!
Non of those really apply to me if im honest. Im out of options and im expecting them to turn up any day now
Re: Warrant of control!
If you cannot solve the problem, the use option 3 above and the bailiff will eventually get bored and move on.
Re: Warrant of control!
Using option 3 wont help me either will it... they're recovering money for HMRC as its court fines etc? They're allowed to gain entry... which im guessing they will soon enough as its nearly £700. Iv just had them banging on the door at 8am this morning... Marston bailiffs. I didn't answer of course
Re: Warrant of control!
HMRC have extra powers of entry to recover taxes, but HMCTS recovering court fines do not.
Those are two different entities.
