Marston removal notice

Hi, I’ve had Marston delivering RemovalNotice today for the motoring offence penalty. I only had my 12yo daughter at home and bailiff instead of coming back later was really mean and scared my daughter. To cut story short, I spoke with bailiff and asked for few hours.. by then I paid my fine direct to he court.. bailiff was asking for £400 and I’ve paid £250 direct to the court.. can he come back for remaining money? Thanks

Technically yes because the money is not owed to court. It's owed to the council. I'm not sure how you were able to money into court. Only a court fine can be duscharged by paying money into court.

Do a compliance check on the parking fine and the enforcement.

I just went online to court website, put fine reference in and paid

What I’m really annoyed that he left my daughter frightened, that’s the only reason I don’t want to pay hem a penny

It must have been a court fine. Once the fine is paid tge court will consider the matter closed.

But it doesn’t mean I have to pay bailiff, right? I’d rather pay court again than them lot

Also, he frightened my daughter, was talking to her very mean and grabbed her phone when she rang me? Although he knew that she’s on her own. Can he do that? Is there something I can do about it? If there’s a chance to do something will be looking for a lawyer

If your daughter is under 12 and the bailiff failed to leave without making inquiries then the bailiff only breaches official guidelines. Unless she suffers mental trauma, there isn't much legal remedy. If mental trauma occurs, then remedy exists in the form of a personal injury claim. http://www.nationalbailiffadvice.uk/Ass ... iliff.html

If the child was under 18, the bailiff cannot take control of goods, but guidelines allow the bailiff to make inquiries when the debtor will be home. After that, the bailiff must withdraw from the property.
