Unpaid Dart Charge Fine - JBW

Hi all,

I have just recently moved to Cardiff but I am still in contact with my old flatmate who still lives in my old flat. I was back in London and stayed over at my old flat this weekend and was surprised to find a letter from JBW regarding an unpaid Dartford Crossing charge in mid June last year.

It’s a strange one because I actually used the Dartford crossing later on in June and July, on two separate occasions. Those two crossings I paid for online but apparently I have this one crossing where I forgot or thought it was out of charge hours or something. I have a receipt for those two other crossings.

The tricky thing is that I was not aware of this charge until today. I suspect this is because my vehicle is registered at my grandparents’ old address (which I had previously lived at) which was vacated early last year. Admittedly I forgot to change the registered address when I moved. I don’t know how they found out what my actual address was but they did.

The biggest concern is that fine has just increased further to a ridiculous £425.50 as JBW have apparently visited my old flat (likely when my flatmate was out because we weren’t aware of this), and I hadn’t read the letter and responded/paid in time for this visit. According to the letter that visit was on 08/03/18.

I don’t see why my mistake in forgetting to change the registered address on my vehicle should result in me having to pay £425.50 instead of £35, which is what I understand the fine would have been if I had been aware of it.

Is there anything I can do to avoid having to pay this huge fine?

You can appeal the PCN and once that has been granted, you pay the original fine, or appeal it on the grounds the contravention did not occur.

You need to find out from Dart Charge what the PCN number is. It has two letters followed by eight numbers. You cannot appeal without it. It might be on the JBW paperwork, but if its not then the bailiff probably won't give it to you voluntarily because they will say they must come round first.

Dart charge can give the PCN number if you know the car registration. 0300 300 0120.

When you appeal the charge to the Traffic Enforcement Centre, you must specify that you did not receive notice because the address is wrong. Give evidence of living at another address - otherwise the court will dismiss your appeal.

Hi I know this is an old thread but i have a question. I got two letters forwarded to me from my old address from JBW claiming i owed £381 in total across two Dartford toll charges. I was also threatened with a £1000 fine from The DVLA for not changing my address on my V5 straight away and they pressured me into paying it despite my saying i didn't think they could enforce it if I hadn't seen the letters.

The £381 has been paid now but I wonder if you could advise me on any unlawful practice that they have gone through with me there and if indeed i do have a case for dismissal and only the original fee?

I'd appreciate any advice here and next steps in trying to reclaim the money

Appeal them and select the option "you did not receive a Notice to Owner (NTO)". Remember to attach evidence of your change of address.
